Jurors in Lindsay Clancy’s Massachusetts murder trial told Judge William Sullivan for a second time that they were unable to reach a unanimous verdict after roughly 28 hours of deliberations. The jury is deciding whether Clancy should be held criminally responsible for killing her three children in January 2023. Her defense argues she was suffering from severe postpartum psychosis, while prosecutors contend the killings were premeditated.
Sullivan responded by issuing what’s known as a Tuey-Rodriguez instruction, sometimes nicknamed a “Dynamite Charge,” which strongly encourages deadlocked jurors to reconsider their positions and continue trying to reach consensus. The jury was sent home Wednesday and is scheduled to resume deliberations Thursday. Continued deadlock could ultimately result in a mistrial.
